Jon, it's a civil rights case! It's not a punch card ballot case. The law suit is because African Americans didn't recieve fair treatment. They had fewer voting machines, longer lines and there were different standards used in counting their votes, especially when it came to provisional ballots.
This is also about ballot tampering, here is a photo of an optiscan ballot from Clermont County with a sticker over the John Kerry bubble. Since marred ballots merit a do over, there is no legitimate reason for a sticker to be on a ballot.
Sure this was filed as a civil-rights lawsuit, and alleged disenfranchisement of African-American voters and others in urban and mostly Democratic-leaning hoods. The bottom-line is Cliff Arnebeck & Co. sought to preserve the ballots (which a federal judge has agreed to) so they can prove tampering and criminal intent. Why don't you call Arnebeck if you are confused.
