Elections Commission rules 6-0 against Noy, in favor of Rep. Schmidt

In what they called a "directed verdict," the six-member Ohio Elections Commission unanimously voted to dismiss Nathan Noy's false statement complaint against U.S. Rep. Jean Schmidt.

Commission Chairman William Booth and Vice Chairman Martin O. Parks, who led today's hearing, asked Schmidt attorney Joseph Braun to submit details of his legal fees and all other costs related to the complaint.

If Noy's actions are determined to be frivolous, Commission Executive Director Phillip Richter said, they can act on Braun's request for fees and costs. Richter called such punitive actions against a complainant very rare in his tenure with the commission.

"We shouldn't need more evidence on it," Parks, the acting chairman said of a frivolous complaint finding.

Richter said he'd like Noy to have sufficient time to respond to Braun's request for fees and costs.

Dear Joseph Braun,

I don't know Nate Noy. I've never met the man. But I will say this... "Let it go". If Jean Schmidt would put half the time and energy into her job as our US Congresswoman as she has put into trying to defend her image in the courts, we would have one great Congresswoman representing us in Washington DC.

My personal request to you is to let this whole thing go. Do not pursue Nate Noy any further. I don't know him but I do believe that this whole thing has gotten to the point where it could be defined as a circus. Jean Schmidt's decision on this in the next few days will be, in my opinion, a true test of her character.

I do not want to be represented by a Congresswoman who is willing to waste time and money chasing a few bucks from one of her constituents.

I want to be represented by a Member of the US Congress who is going to do more than shoot from the hip to fight terrorism in an expensive and ineffective manner. I want to be represented by a Member of the US Congress who is going to fight to save Medicare for the baby boom generation and the middle class of the United States of America, not give Medicare away to the insurance companies. I want to be represented by a Member of the US Congress who will fight for tax cuts for working families, not oil companies.

"Let it go". If you do not let this whole thing go. I'm going to start knocking on REPUBLICAN'S doors for Vic Wulsin from Waverly and Portsmouth all the way to Cincinnati. Ten thousand of them. Yes 10,000.

I suggest that you take these comments very seriously. Quit picking on the little guy and start working for the people of Southern Ohio. "Let it go".

I think the problem is Noy not Schmidt. Noy filed the bogus charges. Noy was given a chance to drop the charges after seeing the official result book that confirmed Schmidt running the race and the time. He wouldn't drop the charges. After Pam Saylor presented her information he was given another chance to drop the charges. He didn't. After the photographer confirmed the picture he was given another chance to drop the charges and wouldn't. Nate Noy is no different than Karr who wanted everyone to believe he killed the little Ramsey girl. Noy wanted his day in the press and on TV. He ended up making a fool of himself and the Ohio Election Commission. The Election Commission is going to make an example out of Noy. Don't blame it on Schmidt, she didn't file the charges.

I hear Nate Noy could use some help on his campaign, and I'm sure he'd appreciate getting advice from a winner like you. Go ahead. Give him a call.

On a separate note, to accuse Braun or Schmidt of "going after" Noy is beyond laughable. If you can get past your hatred of Jean, your bitterness, and your self pity, step back and look at the situation objectively. Nate's complaints were completely frivolous. Maybe Jean wouldn't have to spend so much effort defending herself if people like you could just accept defeat instead of being unwilling to accept the fact that you were beaten by a girl from Clermont County. If you're suggesting that Noy should not have to pay Jean's legal fees, maybe you'd be willing to instead? Hopefully you have 10 grand to spare (hardly a 'few bucks'), because I doubt anNoy does.

Jim Parker, you're more than welcome to start knocking on all of the doors you want. You've always been good at wasting your time. Just stay away from my house. My dog doesn't like Democrats either.

Why don't you go door to door and tell the voters of Pike County why you are supporting Wulsin - a pro abortion, pro gay marriage, anti gun liberal. I am sure they will welcome you with open arms.

It's such a pleasure reading something thoughtful that's constructed with an understanding of grammar and spelling and sentence structure instead of the usual sloppy incoherence that often passes for blog comments.

There is no way Annoy's claims were frivolous !

The commission already ruled there was probable cause !

That had to be a wRong wingnut member of the commission to try and intimidate a citizen not to come after their lying candidates, period !
