Will she, or won't she reappear?

Attorneys for U.S. Rep. Jean Schmidt and complainant James P. Urling sparred for more than two hours today over procedural issues before the Ohio Elections Commission.

The main issue: Did Schmidt make false statements on government documents and Web sites about having a second bachelor's degree? Also, did she misstate endorsements on her Web page and in campaign literature from two congressman and the Family Research Council?

Urling's Cincinnati lawyer, Christopher Finney, objected to her lawyer's introduction of 68 pages of sworn testimony by Schmidt during a one hour 25 minute deposition taken last Thursday at Squires, Sanders & Dempsey law offices, 312 Walnut St.

Finney argued that Attorney William Todd promised to resume the deposition after Schmidt left for another appointment. The lawyers never agreed on a date to complete taking her sworn testimony, however. "It is not a complete deposition and we vigorously object,'' Finney said.

Today, Todd quashed subpoena's for Columbus appearances by Schmidt and her husband, Peter, who Finney called to testify in person. Todd said that as long as Congress is in session, and Schmidt is in Washington (and Peter out of the country) neither can appear. "If Mrs. Schmidt doesn't want to be here today, that is entirely in her right,'' Finney said. Todd "could have brought his client to the hearing today. He chose not to do it.''

Todd offered to postpone today's hearing. "If you want to do it when Congress is in session, I can't promise (Schmidt) will be here,'' he said.

Todd said that any continuation of a deposition "would simply be for harassment purposes...I would ask the (elections) commission for a protective order.''

That led to Todd and Finney being peppered with legal questions from Elections Commission Chairwoman Catherine Cunningham. Cunningham wanted to know exactly what led up to Schmidt's deposition and why it was never completed. "He's reading from a deposition we're not allowed to use,'' Todd said, referring to Finney quoting from a document that was not yet entered as evidence.

And Todd entered as evidence a certified copy of Schmidt's undergraduate transcripts from the University of Cincinnati and a provisional Ohio teacher's certificate. Todd said Schmidt had 135 credit hours for her bachelor's degree in political science in 1974 and another 122 credit hours from 1981-1989 in social studies/secondary education. "Those were indeed minor errors,'' Todd said of misstatements that were corrected as soon as they were identified. "They are trivial in the context of her qualifications.''

At one point, Todd asked to go off the record, sat down at a conference table, and put his hands on his face. As he choked back tears, someone handed him a box of tissues. It was later revealed Todd's father recently died, and that events leading up to the deposition were complicated by personal matters.

Finney revealed personal issues of his own, telling a reporter he has high blood pressure, and blamed it on this case. But he told Cunningham that he'd agree to continue the hearing, with an unfinished Schmidt deposition, because voters need all the facts before Tuesday's primary election.

Commission member Martin O. Parks added that it appears Finney covered all relevant questions in Schmidt's deposition, and that she couldn't recall other details.

The commission then took a short recess for pizza, delivered to its Columbus offices.

Good old cut-n-run Schmidt, cut and ran away again. She can't be there when Congress is in session? What a load of crap. She doesn't do anything, doesn't respond to requests for help, and no one in Washington has any respect for her. She might as well be in Columbus to try and clear up these lies with the OEC.

Wait a minute, she got a political science degree with 135 hours, but has 122 hours towards her education degree. That does not add up. Either you don't need 135 hours to be a teacher, or she did do the coursework to get a degree in education and she is still short credit hours. Is this yet another lie by the Schmidt campaign?

YAWN...Chris Finney out-foxed by another attorney? That's nothing new. Maybe Round 2 will provide the voting public with some fireworks...then again, with Finney on the case...probably not. Can't wait to decide this at the ballot box - where campaigns are supposed to be decided. We're acting like a bunch of @#&& democrats, people! No matter who wins, and right now it's looking like Jean Schmidt will win in a squeaker, let's get behind the victor. There are bigger battles to be waged in the Fall.

No one in Congress has any respect for her, however, the two most powerful men in the House endorse her, and there are two local Congressman, and two former Congressman that endorse her. The first post was so untruthful it could have been a script for Bobby the bagger on the Cunningham show.

She is done. If every voter hears of her lies and how her claims against McEwen were thrown out, she will lose.

If she showed up, there would be more press. Her campaign is trying to keep her in a hole. This is amazing for an incumbant to mess up this bad, even with the help of the media and leadership PAC money from DC.

I hope they are working on their resumes at the same time.

I'm just going to focus on our district getting back to normal.

Schmidt has had no problem being in Cincinnati to campaign or attend people's funerals for political gain. The only time she won't show up is if there's a public debate or a legal proceeding.

If Jean had nothing to hide, she would have completed her deposition, shown up for her hearing, and proven to the voters that she is honest. But, that is obviously not the case. Furthermore, where's Stan the Man? She sent a mourning, emotional lawyer in on her behalf? Has she no compassion?

schmidt made a fool of herself in a time when respect is everything. delay and cunningham both took a hit partly due to lack of respect.

she will not bring anything to the 2nd district. except maybe a democrat come november. too bad the dems were the ones publicizing her big blunders last year. wasnt there an anti-schmidt van? (you should have let her get by McEwen, then nailed her, oops)

They only endorsed her because they follow party etiquette to always endorse the encumbant! None of those people could care less about Jean--ask them, they'll tell you the same thing.

Ok, we know Schmidt is a liar, and aligns herself with Democrats when she feels the need. Enough. Don't vote for her. McEwen has a better chance against the Democrats anyway. I will ask them at the rallies, and fundraisers, and lincoln days, and other forums that they have shown up to for HER.

Part of her Poli Sci hours went towards her education certificate, a.k.a foreign language, humanities, courses of that nature.

She isn't done, she has over a 20 point lead and will win on Tuesday. I just want to know if you'll complain, or see that you've blown her up to be a terrible person when she's not at all, you're a minority of people that don't like her, and you're a VERY small minority that think the district is embarassed by her. Plus, who wants a career politican to represent them anyway, that is like, so 90's, oh my gosh!

a minority of the people like her but the vast majority think mean jean is also an embarassment to the second district. why would you want a congressmen who can't work with anyone because she's not only incompetent but also a bully. maybe she should go back to teaching aerobics where all she has to do is say 1-2-3-4 and not talk about things she knows not of. she was found guilty today because she's a liar and she will get beaten may 2nd when the people of the second district choose to be respected in congress... go home to daddy's mansion mean jean

Who wants a career politician?? Are you kidding Jean has been in politics for over 20 years. And along the way she has bullied people and run rough shot over those who do not like her. Career politican is exactly what she is. I want someone in DC who has experience there who can get things done. Who has respect of his those in DC. I want someone who will not embarrass us on the floor of the house. I want someone to get something done for us in the 2nd district. Best chance for that is BOB McEWEN.

You say Jean is ahead by 20% points. There is noone who really believes that. That is just political reteric and/or it shows how out of touch you are. Jean would never have hired a Democratic lawyer to file a bogus lawsuit as a political stunt if she did not feel she was in real danger of losing.
I find it funny that you defending her lie about having 2 degrees after a 7-0 vote that she lied about having 2 degrees. Say what you want she does not have 2 degrees and it was a lie used for many, many years. As was the lie that she taught for 4 years. No teaching degree no teaching for 4 years. You can rationalize all you want but she LIED and has LIED many times.
She may not be a terrible person but she has acted terribly. She has pulled political stunts and been caught lying.

Oh by the way I am 23 years old. Many of my friends are voting for Bob also.

I guess the old person statement was just another smoke screen like your comment about being ahead by 20 points.

Zzzzzz. Schmidt better turn out about 30,000 people in Clermont, all for her, because the only votes she's getting in Hamilton are from Michelle Schneider and
whichever old people Michelle can intimidate at the nursing homes she owns.

Republicans are the majority party in this country and will be for years to come. With apologies to Reds 3B Chris Sabo: "We got the White House, we got the Congress, we got the State of Ohio and you liberal nutjobs got nothing!" There are many reasons to vote for Bob Mcewen. 12 years in congress. Bob funded the Clermont Waste water treatment Plant, and they named it after him! He got the water from the Army Corps of Engineers for Clermont County. He got the money to build SR32 from I-275 to Marietta and I-77. Bob got money for a water treatment plant in Scioto County.
Proven man working with local government officals to provide necessary infrastructure for his communities. Vote for Bob McEwen!!!
