Latest elections complaint against McEwen tossed

The latest campaign complaint against Bob McEwen, who is challenging U.S. Rep. Jean Schmidt in Tuesday's Republican Party primary, was dismissed today by a bipartisan panel of the Ohio Elections Commission.

After about 10 minutes of questions, and no discussion, the elections panel voted 3-1 that there is "no probable cause" that McEwen, a former congressman, made false statements about living and voting in Ohio.

Schmidt's campaign manager, Allen Freeman, filed the complaint Friday.

Freeman's Columbus attorney, William Todd -- who argues dozens of cases before the state commission each year -- called it "probably one of the most significant false statement cases I've ever seen.''

Todd argued that McEwen has repeatedly stated that he is an inhabitant or resident of the state of Ohio, but has not been "for many, many years.'' As one example, Todd cited the Fairfax Station, Va., home the McEwens have owned since March 1997 and "maildrop" that McEwen uses as his current legal address at 7382 Ridgepoint Drive in Cincinnati.

But McEwen's Columbus attorney, Donald Brey, another seasoned elections law expert, called the complaint frivolous. Brey argued that Freeman never questioned McEwen's Ohio voting record in 2002 through 2004, because the former congressman lived in Hamilton County during that time.

Former president Ronald Reagan called himself a Californian, Brey said, even though he lived in Washington, D.C., for eight years.

Referring to McEwen's campaign literature and advertisements that state "this is our home and you are our neighbors,'' Brey insisted they are not false statements.

Two Democrats and one Republican commission member agreed, including former state Sen. William L. Mallory of Cincinnati. Republican Benjamin F. Marsh was the only commission member to vote against dismissing the complaint. He declined to comment afterward.

During a hearing later today, the full seven-member elections commission will hear evidence in two separate complaints against Congresswoman Schmidt. Those complaints filed by James P. Urling of Norwood allege Schmidt included false information about her undergraduate degree on her resume and included endorsements she never received on her campaign Web site, among other charges.

The fact remains that Bouncin' Bob McEwen is still a carpetbagger from Virginia. The voters will weigh in with their decision on Tuesday, and I don't think Bob will like that judgment one bit. Jean Schmidt is a lifelong resident of the 2nd district. She's not trying to pass herself off as something she's not.

Wow - gojeango sounds alot like Dick Cheney. Even when faced with a bipartisan decision that should put this residency non issue to rest they still whine whine and whine. Next this gojeango nut case will tell us the insurgency is in it's last throes and the Iraqi oil revenues will pay for everything. The best part of May 2 - hopefully all these non stop whiners like gojeango will finally shut up!

Jean's constant attacks against McEwen are just not working. Her campaign must be in real trouble. I hear her negatives in the polls are very high and why she has not released most of her polls. McEwen was forced to run some negative ads because Schmidt went negative when she hired liberal democrat lawyer Stan Chesley to do her dirty work for her. That's what you get for bringing in a real light-weight like Freeman to mis-manage your campaign.

Hey people I love how you throw out "sinking ship" or this race is over. I think we all know that is not true. You wish it but it is not true. I think we know that Bob had done an amazing job in this campaign of trying to take the incumbant out. I find it funny that as it is more and more obvious that this is close the Schmidt people say sinking ship or we are up by 20% points. Sounds like nervous poeple. You are so deperate that you hired John Kerry's number one fund raiser to file bogus lawsuits against Bob. Lets see every complaint in court or elections commission against Bob gets thrown out right away. Today in the residency issue they ruled there was no probable cause to go forward. That means they said there was no reason to even have a hearing. meanwhile weeks ago the complaints against Jean (not filed by the McEwen Camp) were found to have porbable cause adn today she is going through a hearing on those. Bob's thrown out before a full hearing, Jean's going to be heard by Commission. Keep saying "Carpetbagger" the commission today said not true and not going to listen to it.

Now you also complain about flyers. First 4 flyers in 4 days. Know for a fact that the McEwen people have not sent out 4 in 4 days. So you are once agian telling a half-truth. Thats ok beacause you all hide behind half-truths. I don't think they are negative when they tell the truth. Each statement about Jean is true and backed up by articles in the paper. They say bad things about Jean. Yes like she told lies and made claims that were not true. If the turth is negative then too bad.

Bob will be able to do a much better job of getting things done in DC for us. I want the person who is most experienced with how to get things done for us in Southwest Ohio. And yes Bob's experience in DC is and will be a good thing for this district. Maybe if Bob gets back we will actually see some positive progress in the 2nd District.

The desperate attempts to disparage the credentials of Bob McEwen, as an Ohioan, not only say a lot about the ethics of the present Congresswoman. They say something about her understanding of the principles of Federalism.

America is a Federal Union of sovereign States. State citizenship is not something that is lost by a temporary sojourn in another State, unless one intends to be permanently domiciled and to seek citizenship in that other State. The Schmidt gambit is an insult to all of us, to whom being an Ohioan is important. That Bob McEwen continued to consider Ohio his home and to stand tall as an Ohioan, shows that he understands the principles of Federalism.

That the likes of Stan Chesley--the most notorious Clinton supporter in Southern Ohio--would undertake to try to promote the Schmidt gambit, also says a lot. The speed with which he withdrew the show-boating Complaint about Bob confirms my suggestion, the other day, that he should be subject to Rule 11 Sanctions for ever filing the same. (Now if Stan really cared about State citizenship, he would have spoken out against the outrageous way that the Clinton's with no New York heritage, suddenly became citizens of New York.)

Yes, the McEwen campaing has sent out four flyers in four days I have them to prove it. I got another one today. I don't care one way or the other because I am voting for someone else. I just wanted to tell anonymous at 1:27 he is dead wrong.

Finally! I hope this news makes the front page (at least of the Local section) in the Sunday Enquirer! How about "McEwen Completely Exonerated" or "Schmidt's Lies Against McEwen Fall Flat" or "We Were Wrong About McEwen". How about a big, huge apology from the Enquirer for reporting Schmidt's lies about McEwen though they were fact?

Then, when they also report about Jean's OEC hearing (probable cause was already determined in her case, and she's now in the 2nd phase of being questioned) it should be on the front page noting how she actually did something wrong, and it's been proven. They might also mention that the McEwen campaign had NOTHING to do with charges being brought against her, because he is above suing his fellow Republican (if you can call her that)!

Someone who refers to himself as "usefullidiot," makes a comment about Jefferson and the Federalists.

Well, "useful," what exactly is your point? To Madison and Jefferson, State citizenship was more important than it had been to the Federalists. Up until the 14th Amendment, States defined Federal citizenship. But, of course, the point is that Bob McEwen would not lose his Ohio citizenship, simply by working out of the State. And the idea that he would is an insult to all of us, who are proud to be Ohioans.

By the way, does Mrs. Schmidt claim that Herbert Hoover should not have been allowed to run for President, because he had lived many years in China and other overseas venues, pursuing his engineering career? Just how far does she intend to take this silly nonsense. Would it not be easier for her to face the issues than pursue this idiocy?

Bob voted early because it’s was his right! Also, he knew that it would really get under the skin of the Schmidt campaign, which worked. I bet smoke was coming out of Mean Jean’s ears when she found out that Bob out smarted her once again.

What about the Highland County Board of Elections??? I have copies of 3 letters that were sent to the McEwens stating"Mrs. Lyles house is not your home. You cannot use her address in this format....a unaimous vote to cancel your voter registrations here in Highland County, due to none of you meeting the residency requirement." from Joyce R Harvey, Director

Those ridiculous letters you are talking about were used in the complaints against Bob and sited by Dem lawyer"Stan the ambulance chasing man" They and all of Jeans bogus claims about residency have been tossed out. Glad to see the can't move on when you have no groud to stand on.

Lets see Jean found gulity of lying about several things, Bob's residency complaint thrown out in 10 minutes.

Mr. Flax, surely you don't mean to say that the law allows someone to move away(not in public service) to another state for 14 years, pay taxes in another state, own your principle residence in another state and still return the your birthplace and vote!? Why would we allow people who no longer live here and support the local economy to come back here to influence elections with their vote? I don't want a bunch of people that have relocated permanently to Florida or California to come back here to vote for their choice! Candidates should be chosen by the local voters. Issues should be decided by local voters. Votes should be important and mean something. Just because someone can afford to rent an apartment in another area does not and should not give them the right to vote in their chosen area.

Duhh!!! He was the President!! in service to his country!!
Mr McEwen stopped being "IN SERVICE TO HIS COUNTRY" when he was booted from office in 1992!!!
By choosing to stay in DC/Virginia after 1992 he started the clock ticking. Ohio Revised Code states that a person who "continuously resides outside the state for a period of four years or more, the person shall be considered to have lost the person's residence in this state, notwithstanding the fact that the person may entertain an intention to return at some future period."

I love how you are making points about something that the Ohio Elections Commission in 10 minutes voted 4-0 that there was nothing there. This was 4-0 that there was no reason to take this to the full board. The Full Board is what ruled that Jean told lies today. You Democratic Lawyer filed a bogus lawsuit that a few hours later was gone and out of the courts. You are making an arguement that has shown to have no legal basis at all. If you don't like that Bob lived in Virgina for awhile that is up to you.
Of course you want to ignore the fact that Jean was found today to be gulity of lying about endorsements and education.

You need to find another issue but maybe you should find a way to defend you lying Canidate.

Vote for a monkey--nothing changes. The insane beaurocracy, governed by lobbyists, just rolls on, crushing the citizens of this country under an enormous tax burden, never-ending helplessness and total futility. So, what's the difference: McEwen or Schmidt. It means nothing. Whoever. Nothing at all will change.

Yes, it takes a lot to make even small changes in government, but don't lose hope. You're interested enough to read these blogs, so you must still care. It would be great to have more people like yourself join up with your local party and hang in there to make a difference. Bring along some friends, and try to meet with candidates and elected officials. If they saw more people staying up on issues (other than just those looking for or trying to keep a job) and holding them accountable on a day to day, or week to week basis, a lot could change!
