Seen Any Garry Signs?
Brian Garry says you won't.
After his unsuccessful bid for City Council last week, his team started taking down his signs at 7 a.m. the next day. He says by noon Wednesday, "practically every Garry sign had been successfully retrieved."

Kudos to Brian. Now if Jeffre and Harper will do the same we'll return the West Side to some semblance of normalcy.

The only time I would use the word "practically" in association with Brian Garry and his yard signs- is that Brian Garry's yard signs were practically all illegally placed.
Good for him for taking down his illegal yard signs. That is very noble, especially given the fact that he placed so low and was just shy of 10,000 votes from making it on council.
Let's hope that Harper, Jeffre, Painter, Pavelish, Zamary and Fischer follow his lead in removing all their illegal yard signs.
We did remove our signs last week from all locations. If there is a sign still up that we forgot please call me at 621 0034. We ran a honest campaign and don't lump me in with other candidates who you seem to disrespect.

On 11/12/07 I saw a Garry sign in Hyde Park...guess the "Green" candidate isn't quite so green

I appreciate your comments, especially congratulating Berding and Ghiz. That was very respectful.
However, that does not dismiss the fact that your signs were illegally placed all over the city.
AND, your signs are illegal in and amongst themselves because they lack language indicating that you were running for council. The way your signs were phrased implied that you were already on council, which amounts to voter fraud. See Ohio Revised Code section 3517.21 Infiltration of campaign- false statements in campaign materials – election of a candidate.
Here are the relevant sections of ORC 3517.21:
(B) No person, during the course of any campaign for nomination or election to public office or office of a political party, by means of campaign materials, including sample ballots, an advertisement on radio or television or in a newspaper or periodical, a public speech, press release, or otherwise, shall knowingly and with intent to affect the outcome of such campaign do any of the following:
(1)Use the title of an office not currently held by a candidate in a manner that implies that the candidate does currently hold that office or use the term “re-elect” when the candidate has never been elected at a primary, general, or special election to the office for which he or she is a candidate;
Mr. Pavelish, because your campaign yard signs did not state that you were "for" City Council or "elect" Pavelish, they are illegal on their face.
The honest of your campaign is thus validly called into question for these 2 illegal activities.
Next time you run I hope that you decide to obey the law. Nothing against you personally.
My signs were approved by legal council and reflected nothing illegal. Plus the bold letters giving my website and inviting you to my website (Thousands did)indicated that I was a candidate. Plus the FULL TIME part on my signs (City Council, remember is part time) shows that I am not claiming any title (there is NO FULL TIME Council) but that of a candidate. We had this conversation before on the blog. My campaign is and was honest in '07 and will be again in '09.
The campaign is over. I lost. I accept and respect that. I congratulate the winners and offer my help to Council to move the City forward. There is much work to be done.We must all be on the same page and include the People in City decisions.

I respectfully disagree.
Your legal counsel is incorrect on this issue. Just because legal counsel approved of something does not make it legal. Yes, you can insulate or limit yourself of some liability by relying on the advice of a legal professional, but that does not change the fact that your signs were illegal and illegally placed.
Have him/her re-read the relevant sections of the Ohio Revised Code and the advisory opinions released by the Ohio Elections Commission,
The inclusion of your Web address and the notation of "Full-time council" does not make your implications of being on council less confusing.
The law was put in place to combat confusion, not lead to it. Directing someone to a Web site that then states you are seeking elective office, having never held it before, does not clear you of wrongdoing.
Nonetheless, I applaud your recent effort to gain a seat on council, and will be happy to see you run again in 2009. Hopefully by then you will change your signs and place them in legal locations.
Garry forgot about the signs on the I-75 ramp downtown and the ones in the median on Rvier Rd.
