Response to "super-sized tax"

The opponents of Issue 27 (the jail/safety plan sales tax increase) launched their campaign today with Big Macs and super-sized fries.

Later that afternoon the supporters of Issue 27 sent this document out via e-mail to rebut any points or potential inaccurate information that might have generated from the campaign launch.

Here's what they said. "Led by Commissioner Pat DeWine, the opponents of Issue 27 have begun distributing a variety of so called facts and theories about the Comprehensive Safety Plan that, on close analysis, are simply not accurate?

Attached is JUST THE FACTS. It sets the record straight for media and citizens, in order to have a well-informed debate for this November."

So, the proponents of this tax, who supported last years tax, now say last years tax was a horrible plan. Now, we should believe them when they say this is a good plan?

Pepper and Portune are too scared to debate. They refuse to ask for a televised debate and they imposed the tax because they know the plan isn't comprehensive.

Speaking of misinformation, why is Simon Leis telling County Commissioners that there are very few early releases, all of whom are female and non-violent, while going around to other groups and saying there are thousands of early releases per year? I think David Pepper and Todd Portune need to condemn Leis for his misleading statements.

What is the alternative? How is the jail problem solved? Why won't any of the anti-jail people answer this question? DeWine cries about how bad the plan is but never offers a realistic plan of his own.

Someone come up with a better plan to convince me to vote against the sales tax. Voting "No" doesn't solve the jail problem.

The we demand a better petter plan group can't think up any alternatives on their own so they're trying to solicit a "better plan" from everyone else.

Face it folks - there isn't a "better plan" that's why one hasn't been proposed - it doesn't exist.

You are not allowed to use the power of the government to promote or oppose a levy, and elected officials are certainly not allowed to use their position to get their employees to vote a certain way. That is a legal violation.

If George Bush sent an email to federal government employees telling them to vote for him, that would be illegal. If Pat DeWine sent a letter to county employees telling them to Vote No on 27, that would also be a violation. Simon Leis is not above the law.

I agree that Leis shouldn't be using the facilities/equipment/personnel to promote a particular vote -- the lem is that there was no net cost incurred by the public for his conduct so at best, all he can get is a restraining order that prohibits him from doing it again.

Since it is illegal and against public policy to use facilites, etc. in this manner - the court cannot order Leis to allow anti-safety groups to have the same access provided already.

Furthermore, Leis has constitutional authority to act in safety issues - do I think he abridged the intent - yeh, but is it a close enough call that the court won't /can't issssue an order or penalty - probably.

The bigger problem is the lawyers on the anti-safety side are mediocre at best, and have failed to find the REAL law under which to prosecute this conduct, and has failed to file the proper motions to insure it is done

In other words, this will end on te incompetence of counsel

anon 3:34, on one hand you are admitting that Leis did something illegal. Then you're saying nothing can be done about it except to tell him not to do it again. Is this how our justice system works? A Sheriff can break the law and not suffer any punishment for it?

Sorry, if this is Hamilton County Justice at work, I have no interest in paying higher taxes for 15 years to expand the injustice. It would be nice too if we had a Prosecutor who was willing to do his job.

I'm the one most overlooked when it comes to our elected officials making decisions, the average Hamilton County taxpayer. I've never proclaimed to be an expert on any issue, but I do feel I have a pretty firm grasp on the Jail Tax issue. I have been willing to come to any and all community meetings and discuss it and have met the sheriff there many times. It's funny that you admit to not knowing anything about me, yet you don't trust me. I'm not trying to tell anyone how to think, I'm just trying to present our side and give you the facts so you can make up your own mind.
