Judge: Brinkman is "real culprit"

Two women convicted of falsifying election petitions to meet quotas for bonuses were put on probation and ordered to do 200 hours of community service, but a judge said they were minor players in a much larger “mean-spirited campaign.”

Hamilton County Common Pleas Judge Robert Ruehlman reiterated Monday what he said last month when Lois Mingo and Precilla Ward pleaded guilty to charges of election falsification: that State Rep. Tom Brinkman, who headed up the petition drive for the unsuccessful effort last year to repeal the city’s gay rights ordinance, should be charged.

“To cheat on petitions in an election is to really rob people of freedom. It’s the foundation of democracy,” Ruehlman told the women. “You have to pay for that.”

Ruehlman, a Republican, went on to say: “I still think real culprit is Rep. Brinkman.”

“I know politics,” Ruehlman said. “Somehow (Brinkman) falls between the cracks and is not prosecuted… the guy in power is the one who should have been indicted.”

Brinkman, R-Mount Lookout, was not in court Monday. When contacted by the Enquirer, Brinkman said “no comment” and hung up.

Hamilton County Prosecutor Joe Deters, a Republican, previously explained Brinkman’s conduct was in a “gray area” and was a not clear-cut violation.

A grand jury heard the case and declined to indict Brinkman, according to Deters.
Ruehlman said during the sentencing that Assistant Hamilton County Prosecutor David Stevenson told him during pre-trial discussions in chambers that Brinkman changed signatures, but that Stevenson was now “backing off” that statement.

Stevenson did not return a call for comment.

Brinkman told the Enquirer last month that he made no changes.

The petitions were an effort by Equal Rights Not Special Rights to overturn a gay rights ordinance passed by Cincinnati City Council in spring 2006 that protected gays and lesbians from discrimination.

The group, chaired by anti-porn activist Phil Burress, collected two signatures more than the 7,654 signatures needed to get the referendum on the ballot.

Equal Rights Not Special Rights contracted with Brinkman to help collect signatures. Brinkman in turn used some workers from Labor Ready, a temporary job agency, to help collect the signatures.

Mingo, 48, of St. Bernard, and Ward, 33, of Winton Place, worked for Labor Ready. Each earned bonuses based on the number of signatures they collected. It’s not clear how much the bonus was.

Citizens to Restore Fairness, an offshoot of Equality Cincinnati, a local group that works for the rights of gays and trans-gendered people, challenged the petitions. They filed a complaint with the Hamilton County Board of Elections saying many of the signatures were phony.

In several instances the names and addresses of the signer were crossed out and replaced with the addresses of registered voters in order to make the signatures valid.

Burress withdrew the petitions, but the complaint was forwarded to prosecutor’s office.
Prosecutors determined campaigns are allowed to strike out information on a petition, but only if it’s done ‘under the direction and by the authority of the signer.”

Brinkman told prosecutors a lawyer had wrongly advised him that the addresses could be altered.

David Miller, vice president of public policy for Citizens for Community Values, a sister organization of Equal Rights Not Special Rights, said Brinkman did nothing wrong and that the right people were prosecuted.

“Anyone that commits election fraud needs to be prosecuted,” Miller said. “We encouraged this action to be taken as soon as we heard about it. Tom Brinkman did the same thing.

“Those who have committed election fraud have been properly prosecuted and sentenced,” he said.

Gary Wright, the former president of Equality Cincinnati, who filed the complaint against Brinkman with the Board of Elections, said he still isn’t satisfied.

He wants an independent prosecutor to look at Brinkman’s role in the fraud.

“The prosecutor’s office can’t possibly be objective,” Wright said. “The judge let the prosecutor’s office off too easy.”

Dang! I wasn't even thinking about election fraud when I wrote this, either large-scale (Blackwell) or small-scale (Brinkman).

Stop drinking the Red Kool-Aid. The Repugnicant Party is finished. You better hire yourself a good lawyer, because if you have any connection to a Repugnicant elected or party official, you can count on the FBI, DOJ, IRS, and who knows who else (thanks to your President's shredding the Constitution, the next Democrat President can pretty much have his or her way with investigating you) crawling up everywhere you've been with a flashlight and bug spray when we shut down the Repugnicant Party as a corrupt organization under the RICO statutes. Think it can't happen??????

Foley, DeLay, Ney, Taft, Abramoff, Cunningham, Doolittle, the illegal Iraq War, Rumsfeld, Halliburton. What's the common denominator? The GOP. Think they aren't connected? Ha! RICO helped put the mafia in jail, it can do the same to the Repugnicants.

And all your "friends" who you gave money to for "access" or on whose behalf you rung doorbells or stuffed envelopes "for an IOU" will be too busy working with their fancy-pants lawyers and accountants to gave a rat's rear end about you!

We are cleaning out the Municipal Court bench and all the patronage hacks working for it this November! Brad Greenberg, whose only qualification is his ability to suck up to Hartmann and Deters, GONE! Heather Stein Russell, Bob Taft's choice for Hamilton County, GONE! Julie Stautberg, who did Heaven knows what for the Repugs at the Board of Selection, GONE! Uncle Tom West, GONE! Taft appointees Bernat and Bouchard, GONE!

Bush will be gone thanks to the Constitution (this might be the only time he respects it), but we are coming back for you, Steve Chabot! We are coming back for you, Tom Brinkman! You could get a grand jury to indict almost anyone. The fact that they couldn't even get an indictment shows there is absolutely no evidence to support this judge's rant. Those who broke the law were prosecuted and they deserved to be.

In other words, the judge lied. He made an accusation based on what he was "told" by an assistant prosecutor. Now it turns out he didn't even make the statement. It sounds like Ruehlman's ethics are no better than Jean Schmidt's.

What do you expect from a guy who makes over $100,000/year and declares bankruptcy to weasel out of his debts? Poor guy, can't make it on a 6-figure salary.

A local judge has defaulted on his mortgage and filed for bankruptcy.

He makes more than a $100,000 a year, but Hamilton County Judge Robert Ruehlman has run into a bit of financial trouble.

Ruehlman has many years of experience on the bench. He knows what he is doing and he knows how to behave. He is also a died-in-the-wool Repug. Where are you going to find enough Democrats to run against these people? There's only so many Mallorys to go around. And one with virtually no criminal experience is considering running for Judge. Imagine that. But, the name Mallory gets one everywhere.

Judge Ruehlman is the man. Brinkman will get his just deserves.

Thank God Ruehlman got some cojones at the end of his career - I think some of the good ole boys are sickened by what the rat-pack boys (Deters, Allen, Hartmann, Heimlich DeWhiner) have done to their party and their legacies.

As to a prosecutor "backing down" from his comments - buddy, ling to a judge is grounds for disbarment - tell the truth or I'll make darn sure there is an investigation. In fact, I think Marc Dann needs to investigate Deters attempted cover up of Brinkman's conduct. NOW!

Again, good job Ruehlman - your candor might be the breath of fresh air needed to breathe life back into the Republican Party and what their supposed to stand for

Perhaps he's unfamiliar with the American system of justice, where you are innocent until proven guilty.

Here, this moron judge has declared his opinion on Tom Brinkman when a grand jury of 15 people already heard the evidence and said there wasn't anything that Brinkman did wrong.

It's an absolute travesty of justice that any sitting judge should be allowed to make comments based on someone's guilt or innocence when the person has NEVER BEEN CHARGED with a crime.

This judge should be impeached for his statements.

The common thread of just about all the posters seems to be -
"My party right or wrong".

I'll support a judge, or political candidate based on the issues and yes their character and ethics.

What goes around always seems to come around. Both parties continuallly succumb to the allure of power.

Up here in Butler county I've usually supported most Republics for county offices. However they've controlled county govt for so long that they've forgeten they are public servants.

Case in point - Michael Fox retires as county commissioner with a very substantial pension and then applies and is appointed as head of Children's Servies. His only qualification is that he says 'I like children and want to protect them'. For an addtional hundred grand the commissioners hire a qualified person to be Fox's sidekick.

This is why independents like me get tired of all the promises and pontificating from politicians of both parties.

In the end for many, but not all politicians it's about power and what they can do to help themselves.

So maybe in 2008 we'll see a lot of new Democrats. They'll try to consolidate their power. Scandals and corruption will occur. Back come the Republicans. And so it goes.

Am I cynical? No - I'll continue to exercise my civic duty to inform myself and vote for enlightened, ethical candidates that aren't completely subserviant to their party.

Judge Ruehlman should be reprimanded for his intellectually bankrupt remarks concerning Tom Brinkman. If there was any evidence that Mr. Brinkman was involved in election fraud, the grand jury would have indicted him. Since it didn't, Judge Ruehlman should keep his mouth shut. Judge Ruehlman was right about one thing, however; he does know politics, which is why his wholly unprofessional and potentially slanderous remarks smack of a timely smear campaign against Mr. Brinkman. It begs the question: for whom is Judge Ruehlman playing waterboy? Rumor has it that Si Leis, Joe Deters, some judges (guess who?), Pepper and Portune are retaliating for the Coast initiative stopping the sales tax for the new jail. Ruehlman apparently drew the short straw.

I think anonymous 11:50 hit the nail on the head. Some politicians are upset they won't be getting more of our money, and they're taking it out on any convenient target who worked to stop the tax hike.

I can't possibly be the only one who's noticed that the personal attacks on those on the anti-tax side have skyrocketed since petition campaign succeeded. They can't debate the issues so debate the person? Shouldn't they find a better stooge than Ruehlman, though? Someone with an income of over $100,000 per year who uses bankruptcy to avoid paying his bills is probably not the best person to lead a battle of personal attacks.

"WASHINGTON — California Rep. Bob Filner was facing charges Monday for allegedly assaulting an airline worker at Dulles International Airport after becoming upset that his luggage had not arrived at a baggage carousel.

Filner, 64, is slated to appear in Loudoun County, Va., General District Court on Oct. 2. Court officials could not say whether the San Diego Democrat had been served the summons yet to show up on that date.

According to law enforcement officials, Metropolitan Washington Airports Authority police were called to the United Airlines baggage claim office at about 6 p.m. Sunday evening for a report of an incident with a passenger regarding his baggage.

"The individual allegedly attempted to enter an area authorized for airline employees only, pushed aside the employees outstretched arm and refused to leave the area when asked by an airline employee," according to airport police.

"When MWAA officers arrived a few minutes later, the man had left the office and was waiting in the area of a bag carousel. Officers interviewed him and witnesses and released him. Before the individual left the airport, officers advised him that the airline employee would be pursuing charges," the police statement reads.

The statement says the airport worker filed assault and battery charges, a class 1 misdemeanor.

Filner is on his way to Iraq to see the troops, his office said in a statement late Monday, and will have a full statement when he returns.

"Suffice it to say now, that the story that has appeared in the press is factually incorrect and the charges are ridiculous," the statement reads.

A source familiar with the incident told FOX News that when Filner's luggage didn’t show up in the claim area fast enough, he allegedly stormed into the United baggage office and insisted on knowing where his bag was. The agent was working with another customer and told him to wait.

The source alleged that Filner refused to step back and when the worker told him to leave the office, he said, “You can’t stop me.” She replied: "No, but the police can.”

Filner allegedly pushed aside the agent's outstretched arm and proceeded into an area off-limits to customers, where another agent was on the line with police. The agent could be heard from the back room telling him, “You have to go.”

He supposedly responded: “I’m not going until I get my bag. You’re treating us like animals.”

I think you are missing that EG thought "Rep. Bob Filner" meant "Republican Bob Filner" though most of us know it really means "Representative Bob Filner."

In his/her haste to point the finger, he/she failed to realize Filner was a Democrat.

It's an easy mistake to make, considering how well-buried his affiliation was in the article, compared with, say Mark Foley, where his affiliation was in every headline and paragraph.

Incidentally, my neighbor made the exact same mistake with Gary Condit back in the day. She thought "Rep. Gary Condit" was his party affiliation. When I showed her his website, she read the thing about the "Blue Dog Democrats" he was part of and tried to rationalize it by saying, "well, that kind of makes him a Republican."
