After election defeat, Smitherman loses lawsuit

It's been a tough month for Christopher Smitherman.

First, he lost his council seat on Nov. 8.

On Nov. 16, he suffered a legal setback when a judge threw out his medical malpractice lawsuit against Montgomery urologist Philip J. Buffington. Smitherman claimed in a lawsuit filed last year that he was "near death" after Buffington botched a hernia operation months before Smitherman's successful 2003 council campaign.

But Hamilton County Common Pleas Judge Patrick T. Dinkelacker ruled against Smitherman after Buffington's lawyer argued Smitherman failed to produce an expert witness who could testify that Buffington's treatment fell below the accepted standard of care.

Come on Korte! There's no need to kick a man when he's down. I've disagreed with Smitherman's political positions more times than I care to remember but I don't harbor any personal hatred of him.

I honestly don't understand why so many people hate Smitherman. What did he do that was so bad?! All I ever saw him do was aggressively pursue an agenda he thought was best for the city. Phil Heimlich did the same thing.

Smitherman's medical malpractice lawsuit was rediculous and pitiful. He should be ashamed of himself. This is part of the reason health care costs have skyrocketed. Everyone wants to take a shot at the big bucks when their surgery doesn't go perfect. Hello people, anytime you go under the knife you are at risk. It doesn't mean you need to get all sue-happy and attack the people that spend the majority of their lives trying to save people.

Health care costs are sky rocketing because when you let people make an unlimited amount of money off of health care they will. Our system says pay or die and 18,000 people die every year because they don't have health care.

If your surgery was botched, you would want compensation also.

There is still justice in the justice system! Smitherman is a classic example why the poor & the low wage people cannot get a fair shot at decent medical care.

It is obvious that Smitherman's "financial planning" business wasn't all it appeared to be, as people have been reporting. What better way to fill up the family coffers than by filing a frivilous malpractice suit that was proven to be without merit.

What did he do that was so bad? He never did anything right. He will be forever remembered by sitting in front of the TV camera, ranting & exercising his right to psycho-babble.

Smitherman needs to hit the bricks & get a job.

Yes, I'm beginning to think there's something to the assertion that the Enquirer had/has it out for Smitherman. Let it rest.

Does the Enquirer have it out for Smitherman? Or does Smitherman have it out for the Enquirer?

Seems to me he was fair game the moment he put his name on the ballot in 2003. Why should the media treat him any differently than they would any other public official?

Dr. Buffington is one of the best Doctors in this town. I think Chris was just trying to pay his rent and a little more with the law suit.
