Local lawyer seeks to subpoena Don Rumsfeld

Cincinnati attorney Bill Gallagher wants to call former U.S. Defense Secretary Donald Rumsfeld as a witness in a trespassing case against five anti-war protestors.

Gallagher is expected to file a motion today asking Hamilton County Municipal Judge David Stockdale to declare Rumsfeld a material witness in the case against the protestors who were arrested at U.S. Rep. Steve Chabot’s downtown Cincinnati office.

If Stockdale grants the motion, Gallagher can subpoena Rumsfeld.

Gallagher has already issued a subpoena to Chabot in the misdemeanor case that carries a maximum possible sentence of up to 30 days in jail.

“They had a right to be where they were,” said Gallagher, who said he took the case for free because he believes the protestors’ actions were honorable.

Gallagher and three other attorneys represent seven people, including Gallagher’s client Greg Flannery, 48, a 78-year-old nun and two 15 year olds.

The group was arrested Sept. 27 during a sit-in at Chabot’s offices. They refused to leave unless Chabot signed the Congressional Declaration of Peace.

When Chabot, R-Westwood, was unable to meet with the group, all seven were arrested on charges of criminal trespassing.

Gallagher is presenting a “necessity defense,” hoping to convince a jury that the protestors broke the law in order to save human lives and therefore should be found not guilty.

The adult protesters are scheduled for trial Jan. 22. One juvenile case has been dismissed. The other is pending.

Gallagher said the request is not a publicity stunt. Rumsfeld is needed to explain the war’s death toll and cost, he said.

Gallagher said he could subpoena several government officials to discuss the war, but figured Rumsfeld can answer all questions about the war’s death toll and cost.

“He’s retired, he’s got time,” Gallagher said.

Can you also subpoena Congressman Combover, Congresswoman Coward-Caller, Congressman Sex Abuse Abettor, and all the other Repugnicants who let Marcus Feisel die a hideous death while the outsourcing placement companies paid them off????

Great job Bill !

While your talking to Stockdale see if he advised the Ohio Supreme court that he misled voters when he concealed Ruckers Cincinnati Bar Association endorsement.

Also, ask him if he advised the Ohio Supreme court about misleading the voters about his claimed FOP endorsements.

Yes, please subpoena politicians that had nothing to do whatsoever with Marcus Feisel's death in a totally unrelated case. That makes a lot of sense.

The two people responsible for Marcus' death are already standing trial.

Sorry to say but the Feisel murder goes much deeper than David and Liz. Hard for you Republican kool-aid drinkers to believe, I know.

Republicans were then in charge of the county government, the state government, and the federal government at the time this senseless death happened.

The Federal and state legislatures had the opportunity to fix much-needed loopholes in the foster-care system. One simple change would have been to require criminal background checks and credit checks on prospective foster parents (who, after all, receive Federal and/or state aid, administered by the county, to take these children in).

This simple rule change would have disqualified the foster monsters who got Marcus Feisel.

The problem is that such measures are opposed by groups such as Lifeway For Youth who get paid by the placement. Actually having standards for foster parents would slow down the placements, therefore it would slow down their getting paid. These outsourcing companies have taken the jobs of licensed qualified social workers who, more importantly, do not get paid by the placement.

Foster-care providers turn around and give campaign contributions to politicians who do nothing about the foster-care problem because they want to keep their own money flowing, too.

Congress/the legislature could have passed a simple law requiring any agency that receives Federal/state funds for foster-care placements to require criminal background and credit checks.

Right now, it is harder to become a government contractor supplying paper clips (thanks to the criminal background and credit checks) than it is to become a government contractor to take care of a child who has become the government's responsibility.

Chabot, Schmidt, Boehner, all county commissioners in Hamilton Butler, Warren, and Clermont Counties, all the state reps and state senators in the 4 counties, and the last two GOP governors and attorney generals all knew this was a problem and had this suggestion presented to them.

I should know because my family and I wrote to them and talked to them about it.

To a person, every single Democrat expressed concern and wanted to change the laws.

Not a single Republican official EVER had even the courtesy to reply to our letters or even to set up a meeting.

Repuglicans were in the majority the entire time this has been taking place.

They belong in jail as a result of their criminal indifference.

Well, I hope the Dems act fast, because if Bush/Cheney are left in power too long, they will declare martial law and there won't even be an election in 2008.
