More on NoyGate

Nathan Noy, the write-in congressional candidate who filed five Ohio Elections Commission complaints against U.S. Rep. Jean Schmidt is not giving up on his claim she or her campaign fabricated a finish-line photo of the 1993 Columbus Marathon.

Noy said today that he plans to ask the Elections Commission to subpoena several people who helped her during her runs for state legislature because the disputed photo first appeared on her 2000 campaign web site.

Among those to be subpoenaed, according to Noy, are former Ohio House Speaker Larry Householder and his chief of staff, Brett Buerck.

Buerck had no immediate comment, but needless to say wasn't happy about getting dragged into Noy's legal quagmire.

The Elections Commission plans an evidentiary hearing next Thursday, Sept. 7 at 10 a.m.

Here is a copy of Noy's email sent to Buerck today:

Brett,

If you follow the news at all these days I’m sure you’ve seen that I’m going after Jean in the OEC for the fabricated photo she has on her website regarding the 1993 Columbus Marathon. I’ve tracked down another runner from the race and I believe I’ll be producing an alternative photo that does not show her in the same pose as the one I know is a fake.

My preference is to keep your name out of this. I know you’ve been through enough and you and I share some mutual friends. However, it is critical for me to know who doctored the picture. You were a proverbial genius back in the day and our team has a good faith belief you are behind this. However, like I said I’d rather keep your name out of the public spotlight if at all possible.

I assume Exxicte did the photo, but I’m not sure. Later today we will issue subpoenas and release information to the press. Jon Craig at the Enquirer is hot to trot for this story and it will be a headliner for him. I am faced with two options:

(1) Subpoena you to testify at the September 7 hearing at the OEC or
(2) Ask that you tell me who doctored the photo and hope they are willing to admit to it and leave out your name.

Since you are a law student you obviously know that the Character and Fitness Committee will be made aware if you dodge a subpoena or lie under oath to the commission. I think your best bet is to talk to the person that doctored the photo and ask they come forward. Jean is the only one facing charges here and I promise not to pursue anyone else on my end.

Please let me know what you are inclined to do by the end of the day. I have a meeting at 4pm to set the subpoenas. I apologize for the short notice but Joe Braun pushed the hearing date and I just tracked down your contact info this morning.

Again my preference is to keep you out of this. But I will not rest until the truth comes out.

Noy told the Enquirer:

"I tried to do the 'right' thing and give Brett an out by letting him disclose to me who actually doctored the photo.

He responded by requesting a phone call then proceeded to tell me that he considered this a 'threat.' He also said he has released this to the media, the Ohio Bar and the OEC. However, he never denied making the photo. He also told me 'I have a ton of money in the bank and I’ll use every penny of it to hire a team of lawyers to defend myself.' He then told me to 'go ahead and subpoena me.' So, I most certainly will.

My only goal in this remains at getting to the truth. As Jefferson said: 'For here we are not afraid to follow truth wherever it may lead.' and 'It is error alone which needs the support of government. Truth can stand by itself.'"

So let me get this straight. anNoy was claiming that Schmidt never ran in the race in the first place, but now is claiming to have a different photo of Schmidt in a different pose during the race? (imagine that..) Nate, how are we supposed to follow you when you cant even follow yourself? What a waste of time.

Umm..yeah..about that, we can certainly attribute all of her election victories to this one single photo of her crossing the finish line...Friend, you should get out more, and stop hanging around Nate anNoy (my gut says im talking to the man himself..)

And yes, I'm having a blast following this thing. anNoy is like a cockroach that is slowly being burned to a crisp under a maginfying glass. It's like a car wreck. You don't want to look, but you cant help yourself.

I guess just about everything that can be said about Nathan ("Portnoy's Complaint") Noy's complaint has been said. But just to recap: it's frivolous, silly, wasteful, time-consuming, an unnecessary expense, aggravating, annoying (as anonymous at 6:30pm, 8/30/06 pointed out with the cool "anNoy" jibe), irritating and totally uncalled-for. I could go on and on, but you get the picture.
The ONLY people urging ol' Nate on with this confoundedly stupid ploy are Democrats and the "real conservative Republicans" (as they refer to themselves) associated with COAST, possibly including Brinkman, Finney, Urling, that miscreant Jim Schifrin, Beischel (the brain behind the non-debate debate at the Anderson Mercy Healthplex between Bob McEwen and, well, Bob McEwen), somebody who calls himself "CincyJeff" in the blog threads and various and sundry other local political incompetents who couldn't win an election if their lives depended on it. When the OEC puts this nonsense to rest next month and perhaps levies a fine on ol' Nate for their trouble, maybe we can put this useless exercise way on the back burner and concentrate once again on blowing Vic Wulsin's doors off come November. For the record:

(1)The October 25, 1993 Columbus Dispatch did not list Jean in the official results.

(2) Run Ohio Magazine from November 1993 listed detailed results for the race and did not include Jean. I was told that the likelihood of this being an error was less than ½ of 1% by the editor of the publication.

(3) I tried for over six weeks and talked to the current race director of the Columbus Marathon as well as the previous two race directors; no one could produce a copy of the 1993 official results for me.

(4) My official complaint as filed with the OEC states that Jean did not run the race in 3:19:06 (already proven to be true, 3:19:09 is NOT the same as 3:19:06) and that the photo was a fabrication of the truth in violation of ORC Title 35 (Ohio elections law.) Nothing I have submitted to the OEC has been proven to be a falsehood; everything I brought to the OEC was done in good faith and based on facts that would lead any reasonable person to draw the same conclusion that I did. Remember three of the four members of the OEC panel agreed with me that further investigation is warranted here.

I will not run from the truth. I did not expect Jon to post this info here, but it IS true and I stand behind it. Everyone is entitled to an opinion regarding this issue, but it may behoove people to have all of the facts in hand prior to jumping to a final conclusion about the case. Keep in mind which side was already reprimanded for a “reckless disregard for truth” and making “false and misleading statements.” It’s not Nate Noy folks.


I hope to meet you all over the next 60+ days while my team and I are on the campaign trail. Hopefully we will be able to convey to you: “who is Nate Noy?” And we hope you agree that I’m the type of true conservative voice this district deserves to have representing it in Congress.

For the record part II:

(2) If I AM going to post, I’ll do it under my own name. I don’t hide behind an “Anonymous” label (just ask Jon Craig.)

(3) I graduated from The Fisher College of Business at The Ohio State University in June of 2002. I was recruited by the VP of HR at the Steak n Shake Company Robert Grimm to take part in a special program for MBA’s. I was on a fast track to become a franchisee for the company. However, Bob left SNS and an opportunity better suited for my skill set came up and I left the company in February 2004 (after exactly one year and with 8-weeks notice to transition MY store). I can produce 100’s of people every place I’ve been that KNOW me very well. I tend to leave an impression on people. None of my degrees or work experience is fake. Nothing has been removed from the website to hide any truths. If you happen to find any mistakes please make us aware of them and they will be corrected ASAP. I did put up the original site as my team was being formed, however my focus now is not at that level of the operation, yet I certainly acknowledge that I am ultimately responsible for whatever is contained on the site.

(4) I did “flip burgers” I also waited tables, washed dishes and did what ever else my staff needed in times of a rush. I did all of this with much better job opportunities after already having earned a JD, MBA and BA. I’m not better than anyone else, but I do have the experience to know just about where anyone is coming from and I pride myself in being able to relate to people. I could just as easily be sitting in a plush law office somewhere right now out of the public forum, but I truly believe this district deserves honest and ethical Conservative representation, something it’s most certainly not getting today. I also did not think it was fair for me to sit back and gripe about the issues we face without being willing to “put myself on the line.” So here I am.

(5) Ask anyone that knows me the likelihood of me ever being a “puppet” for anyone. Never happened, and it never will folks.

Finally ask John Craig about the Pam Saylor interview and how Joe Braun promised to produce her for me to ask questions to; then he pulled the plug at the last minute. Pam appears to have great recall of the race, I doubt anyone wants to let me ask her if Jean had on red sweat pants.

Back to Jefferson for two final thoughts:

For the record:
(1 & 2)Every runner knows that the only "official" result is published by the marathon not the newspaper or Run Ohio.
(3)As someone who attended law school, I won't call you an attorney because I don't think you have passed the Ohio bar, you should know who publishes the "official" results. It seems that Schmidt was able to locate multiple copies of the "official" result book very quickly and was even able to locate the 1993 race director.
(4)Schmidt never made any claim on her web site of any time or finish position for the 1993 Columbus Marathon. The only thing that was posted was a finish line picture that is taken by a professional photographer who then send runners small copies of the photos to see if the would like to purchase a larger print from him. The photos are usually just near the finish line and the clock in the picture is not the "official" race clock. The finish line picture and the "official" time will almost never match.

Pam Saylor verified Schmidt's 5th place finish. Which has nothing to do with the photo.

The photographer has verified that the picture was his and never altered.

The 1993 race director verified Schmidt's time which supports the picture.

Nate, when this is all done the only reputation you have destroyed is your own. You are a very sick person and should seek professional help.

It's a shame for a person to claim to be a Christian, and then act in such a despicable way.

It's interesting how Team Mean seems to think we've all forgotten that Mean Jean has already been CONVICTED twice by the OEC. If Mean Jean wins this round, that only means she has 2 convictions on her record instead of 3.

Nate Noy has never been convicted by the OEC for anything. Mean Jean has been convicted twice. If Noy needs all this "help" that Team Mean suggests for him, what does it say about the convict they're supporting?

Jeff. She was reprimanded. And her record with the OEC is actually better than that, some of McEwen's complaints were thrown out. Backing up a record with the OEC is becoming easier considering Nate Noy has made them into the laughing stock of the Election Commission world. It's a shame this commission was used to negatively campaign against candidates instead of keep them honest. Since you don't choose to believe what the Congresswoman says, you should look into others around the state who have brought issues up with campaign websites and endorsements. They are usually corrected because of error by web maintenance which usually isn't controlled by the campaign itself. However since COAST hates Jean simply because the middle aged men that are apart of the group can't stand her because she's "mean", so sad huh? It still kills me that Brinkman, and Finney, and Beischel would be so hurt by a woman because she's mean to them, is this a playground? Apparently yes.

I want to clarify a previous misstatement here. In regards to an “Anonymous” label nothing in this thread that does not contain my name was written by me. I have previously posted on other blogs under an alias. I plan to handle my future responses via phone conversations or direct e-mails with the authors of the various blogs or journalists.

As for the other questions regarding me, come to one of our debates and ask it during the Q&A section for a response or e-mail it directly to the campaign.

Anon 4:32: McEwen did not file any complaints. The only complaint against Jean which was tossed out was the claim that her being endorsed by Chabot was false. She was found guilty on everything else: lying about Tancredo's endorsement, lying about the Family Research Council endorsement, and, of course, the false claim of two college degrees.

Schmidt's campaign manager, Allen Freeman, filed a complaint against McEwen, which did not even make it to probable cause.

I don't know where you get off saying "some of McEwen's complaints" were dismissed, when McEwen never filed a complaint and only one complaint against Schmidt was dismissed.

Looks like Jean Schmidt is relying on lies and ignorance to pull the wool over the eyes of the voters. Unless, that is, you are part of her campaign inner cicrle, in which case you are letting her intimidate you.

Is Nate Noy just another schoolyard bulley who targets the little girls with braces? I don't know why Noy and/or Mr. Fishwrap jut want to attack a woman on her looks.

You don't just run dozens of marathons unless you are a far stronger person than the average.

When Bill tried to shoot missiles at OBL in the desert, the Republican-controlled Congress and sleep-at-the-wheel media accused him of trying to take their attention away from the Monica sideshow. There ARE windmills on Cape Cod already and the utilities there are encouraging residents to erect more of them. (Do your research!) And icebergs? They're already melting because of Bush's pro-oil policies. The only reason gas prices are coming down NOW is so big oil can continue to control the Bushies and GOP after election day.

But I don't give a damn about caribou when compared to the absolute vital necessity of oil to the health and well-being of our people. We will change our dependence on oil. BTW, the price of oil has been so high primarily because commodity speculators (you remember Hillary's $1,000 to $100,000 miracle, don't you?) have bid the price up. Those creeps don't work for government or for the Bush family. It's the free market in action. And you Dems will complain about the price of oil if it's up or if it's down, but only as long as you are out of power in DC, may it be forever.

I'm a Vietnam war vet, and I know for certain that we must stay in Iraq as long as it takes. You Dems don't seem to understand that we are at war with a ruthless and totally dedicated enemy. Iraq is phase II. Wait till you see phase III. All wars are very difficult and trying. But this one is to the death, and we have no choice but to win it, period. And we will, with you libs or without you.

You are so typical of the liberals, the Democrats. I've spent way too much time with this, but you touched too many hot buttons with your inane response. I doubt that I'll respond to your silliness and speciousness again.
And I hope your car won't start on Election Day.

I'm a Persian Gulf War vet and registered Republican, so quit calling all of us liberal Dims.

There is a windmill generating electricity just off Route 6 near the rotary in Orleans, Mass. I'll get you the addresses of other wind-driven electric generators if you want 'em.

You are correct about all the failed efforts to get terrorists in the 1990s, but had we gone all the way to Baghdad in Gulf War I we wouldn't be back there today. You tell me how picking Saddam out of a spinderhole gets us one-inch closer to OBL? What are your views on our failed efforts to get HIM, the true villain behind Al-Quaida.
And I didn't need a car today. I bike to work, so I don't have to depend on I-ragheads. So there!
If you think spending a billion-a-week on a war to nowhere is the way to go, why don't you reenlist?
I'd rather be spending our military money repairing the Gulf Coast or protecting us from Syria, North Korea, Iran or China. (now there are some countries worth the Pentagon's time and money.)

Thanks for your service to our country in the Persian Gulf War. You folks did a great job and made us all very proud. I, too, wish we had gone all the way to Baghdad in that war, but the mission was to drive Saddam's butchers out of Kuwait, period. I doubt that the Coalition of the Willing would have agreed to the toppling of the Iraqi govt then. I would have gone ahead with regime change anyhow, damn international opinion. But that's why I'm not Secretary of Defense or State.

I'm NOT arguing the existence or non-existence of windmill generators on Cape Cod. Kennedy is opposed to the construction of more near the family compound, as I said, because it messes up the scenic view. I'm trying my best to point out this recent example of liberal hypocrisy. Perhaps now I've made myself clear.

At my age, re-enlistment is not an option. And as fiscally tight as I am, I hate the money we're spending in Iraq. But I see it as necessary. Apparently you don't. I side with Rumsfeld and Bush and Rice. It's clear you don't. Imagine if we faced a nuclear-armed Iraq with Saddam at the helm AND an Iran with nukes as well. The Iraq phase of the global war is very difficult. Tell me a war that isn't or wasn't. But the establishment of a democracy in that woebegone nation will be a thorn in the side of all the Islamic tyrannies throughout the world. Easy? No. Worth it? Yes.

Finding and killing or capturing OBL is a laudable objective, but at this point I don't think it would make much difference to the final outcome of the global war we are involved in. The terrorist thugs are too loosely organized, too amorphous in form and structure, to be stymied by the death or imprisonment of any of their leaders. Propaganda value? Yes. But the war will go on until we win it whether we have OBL's hide or not. The death of Abu Musab al Zarqawi didn't seem to make much of a difference in the Iraq phase of the global war, did it.

I'm glad to hear you ride a bike to work. If you ever have a medical emergency, I hope the EMT folks aren't riding bikes when they come to rescue you. And if the hospital you're in has a severe power outage, I truly hope the emergency generators aren't powered by good-hearted people like you on stationery bikes. And if your bike ever breaks down and you need to take the bus, I hope it's powered by vegetable oil if there's no diesel fuel available. Oil is the lifeblood of our economy and our way of life at the present time. Keeping the flow of oil coming is vital to the nation's security, health and economic strength. But the handwriting's on the wall. The free market will break our dependence on petroleum eventually, and the damned Arabs can eat their oil, 'cause we won't need it. Until then, we must give our people access to their own natural resources in environmentally safe ways. It must be done for the time being.

You sound like a decent person, even if we don't agree on several vital issues. You may even be a young lady. But I need to tell you that I'll be absent from this blog for a couple of weeks beginning 9/5. All the best.
