Hagan: If Libby's free, why not Traficant, too?

State Rep. Bob Hagan, a Democrat from Youngstown, asked President Bush today to commute the prison time remaining on the eight-year sentence of former U.S. Congressman James A. Traficant Jr., in light of Bush’s recent commutation of convicted former White House aide Lewis “Scooter” Libby.

“If the President is going to coddle criminals in his Administration because he believes they have suffered enough, the least he can do is apply equal justice and release all of those whose crimes had far less impact on the public good than Libby’s,” Hagan said in a press statement.

Traficant, 66, was sent to prison in August 2002 for bribery, racketeering and corruption. With credit for good behavior, he's due to be released from prison in 2009, followed by three years of probation. His fans operate a web site here. And his prison artwork can be found here.

The nine-term Ohio representative became only the second member of Congress kicked out since the Civil War after his House colleagues voted 420-1 to expel him.

Hagan, who ran against Traficant in 2001, said Libby’s actions had more serious consequences than anything the former Youngstown congressman did.

“Libby lied to the FBI and a grand jury about the Valerie Plame cover-up, which undermined the nation’s intelligence operations,” Hagan said. “Add to that his role as Vice President Cheney’s chief of staff in promoting false reasons for going to war in Iraq – and it all outweighs anything Mr. Traficant has done.

“Libby is the first sitting White House official to be indicted in 130 years, and yet he walks away without paying his deserved debt to society.”

Hagan also expressed surprise in what he called "the President’s sudden fit of compassion. . .Is this the same Mr. Bush who touted his record in executing criminals in Texas?”

Hagan sent a letter to Bush, seeking the commutation of Traficant’s sentence.

I doubt Hagen's sincerity. Trafficant, although corrupt, was constantly at odds with the liberal majority in his party. Hagen comes from that hate-America wing of the Democratic party.

There should be NO special reprieves for any convicted elected officials, regardless of party. Let's get rid of all those who believe they are above the law. That said, what Libby and his co-conspirators did was a breach of national security by exposing a covert agent (and thus her network) who was working on counter proliferation of weapons in Iraq and Iran. If you wonder why this woman's work might be exposed, you might want to google Sibel Edmonds and see why a gag order was placed on her (she wants to testify before congress)

Special Prosecutor/US Attorney Patrick Fitzgerald (a Republican appointed by Bush) states it best:

"The sentence in this case was imposed pursuant to the laws governing sentencings which occur every day throughout this country. In this case, an experienced federal judge considered extensive argument from the parties and then imposed a sentence consistent with the applicable laws. It is fundamental to the rule of law that all citizens stand before the bar of justice as
equals. That principle guided the judge during both the trial and the sentencing.

Although the President’s decision eliminates Mr. Libby’s sentence of imprisonment, Mr. Libby remains convicted by a jury of serious felonies, and we will continue to seek to preserve those convictions through the appeals process.”

Libby's sentencing was overseen by Judge Reggie Walton, also a Republican. This sentence was unanimously upheld by a 3 Judge panel in which 2 of the 3 Judges were Republicans. It is a travesty of justice for Bush to commute his sentence (a pardon would have denied him the ability to take the fifth) when it is apparent that Libby remained silent to protect his bosses. If this isn't a conflict of interest(and obstruction of justice), I don't know what is.

Enough already. Are we a land of laws or kings?

and Diane "Former member of the Senate appropriations commity until they found out that my husband was the second largest contractor in Iraq behind Halliburton" Finestein still holding office, Traficante's sentance should be commuted.

Aside from being the sponsr of the most important bill protecting the rights of ALL taxpayers, his biggest crime was standing in the well of the House of Representitives and demanding that Federal law enforcment officials visit 1600 Pensylvainia Ave., and haul the lier in Cheif off in irons.
