Commission: Judge ad ok

Judicial ad OK


A member of the Ohio Elections Commission Thursday called 1st District Court of Appeals candidate Jim O’Reilly’s attack ad on opponent Hamilton County Common Pleas Judge Patrick Dinkelacker misleading, but the four-member commission found no probable cause that the ads are false.

"We would have liked them to go further and we respectfully disagree with the final ruling, but we are very pleased with their comments that the ad is misleading," said Cincinnati Attorney Steve Goodin, who filed a complaint about the ad Tuesday.

O’Reilly said he pleased no probable cause to pull the ads was found.

"I feel very good that the Ohio Elections Commission, which is the state’s expert body on television campaign advertising, rejected all three of the arguments," O’Reilly said.

O’Reilly’s ad says Dinkelacker jailed a alleged rape victim, made an error that allowed Larry Flynt to go free and continue selling pornography in Hamilton County and prosecuted the only death penalty case commuted by Gov. Bob Taft.

Goodin argued that all three claims are false.

An Enquirer analysis of O’Reilly’s ad shows:

It’s dubious that Dinkelacker’s handling of the case allowed Flynt to continue to sell pornography. There’s no guarantee Flynt would have been convicted in 1999 - and it was the prosecutor who initially agreed to the deal.

Dinkelacker did jail a woman who alleged she was raped in 2003, after she failed to appear in court. But she later admitted she lied about parts of her story - testifying that she agreed to have sex with the defendant for $20. The man she accused was acquitted.

Taft granted clemency to Jerome Campbell, a man Dinkelacker helped put on death row. But the decision, made when he was an assistant prosecutor, had more to do with the DNA than the prosecution.

I thought O'Reilly's ad was incredible but was wondering if he stretched the truth. If the Ohio Elections Commission says there's nothing wrong with the ad, I'm sold.

I also looked into some of the things O'Reilly said in his ad. On the Larry Flynt issue, the Appeals Court said Dinkelacker made a stupid error (the Appeals Court decision made fun of Dink, saying there is no such thing as a "double secret probation" like the one he tried to impose). As a result, charges could not be reinstated like Dink wanted and Flynt got off Scott free. Not that I'm a big fan of sticking it to Flynt, but Dink made a bumbling mistake (one of many, it seems).

Same with the rape victim he threw in jail. She was threatened by her rapist. Wouldn't testify. Flynt threw her in jail and she blamed it on someone else so she could get out of jail without the real rapist killing her. The Enquirer statement that "she agreed to have sex with the defendent" is true but misleading. Even the defendent's attorney said there was no question she was raped--she just blamed it on the wrong guy because she was scared and wanted to get out of jail.

And concerning Campbell, Dink decided to show bloody sneakers to a jury even though he didn't know if the blood was from the victim. He makes the ridiculous claim that he wasn't trying to influence the jury, but then why show the shoes??? He cared more about a conviction than following the law or seeking the truth (which is what a prosecutor is actually supposed to do). And guess what? He was wrong! The sneaks didn't have the victims blood on them!

This Dink screws up one thing after another. Get him out of there!

When are you going to report on all those unlawful, deceiving and misleading judicial campaign advertisements the wRong wingnut whackos placed in your fishwrap for their pathetic candidates !

In my humble opinion, concealment is the propaganda tool of the wRong wingnut fishwrap !

Sharon, like usual, you put your Republican spin on everything you write.

O'Reilly had the endorsements of the Enquirer, Post and Bar Association.

His ads are completely accurate. Dinkelacer makes mistakes and should not be promoted to the Appeals Court.

Come on Sharon, lets be fair.

You need better fact checking! Goodin's comment is an out and out lie!! The commission ruled unanimously to dismiss all of Dinkelacker's complaints about O'Reilly's ad. The Elections Commission NEVER said that the ad was misleading.

Reporter Coolidge needs to check the facts before putting outright lies from the Dinkelacker camp on the website.

HERE'S AN AD THAT NEEDS SCUTINY:

Several Ohio television stations have stopped airing a Republican ad because state documents contradict the ad's accusation that Democratic U.S. Senate candidate Sherrod Brown didn't pay an unemployment tax bill for 13 years.

In a debate on Thursday night, Sen. Mike DeWine stood by this debunked ad, saying "Read my lips, the ad is true."
