Clash today at city's Rules Committee

A hearing to grill members of the Cincinnati Human Relations Commission on how they spend city money turned into questions about how a member of city council conducts his business.

During the Rules and Government Operations Committee meeting Tuesday, it was revealed council member Chris Bortz made a phone call last week to a city administrator responsible for executing a contract with the decades old human relations organization, telling the administrator to delay signing that contract until after Tuesday.

“I did get a call from a council member, asking me not to sign the CHRC contract,” said Michael Cervay, director of the Department of Community Development and Planning, adding that he has never received such a request from a council member in his two years at the city.
For good reason.

The request appears to be in violation of the city charter which states that, except for asking questions, council members must deal with the city manager and not the administrative staff. It’s a fundamental rule in the operation of Cincinnati’s city manager form of government, dating to 1925. The rule, written by Charterites, is intended to insulate administrators from political pressure.

Bortz is a Charterite.

“I think the question we should be asking is: Does any member of council have the right to interfere with the process?” councilman David Crowley said. “Are we doing our job and are we doing it correctly?”

Both he and council member Cecil Thomas, former chairman of the CHRC, called Bortz’s conversation with Cervay “improper.” Council member John Cranley also expressed concern over the phone call. None of the three council members said they were aware of Bortz’s phone call until days later.

“I don’t care about the hearing,” Cranley said. “Why was there an effort to hold up the contract?”

Bortz denied telling Cervay to not sign the contract.

“Telling Michael Cervay there’s some concern among council members and (he) might have to amend this contract, that’s information he’d probably like to have,” Bortz said. “He made his own decision. I didn’t tell him what to do. In this one instance, because there was a time crunch, I didn’t go through the city manager.

“I called Michael up, with whom I have a close working relationship, and made him aware that there is an issue that might double his workload. It was just a nice thing to do.”

That issue, relevant to members of city council such as Jeff Berding and Laketa Cole who supported a more conservative budget two months ago, was how much CHRC spends on administrative costs. Cole asked why the organization spent $135,000 on salaries and only $19,000 on programs. Cheryl Meadows, the CHRC’s director, said salaries pay for people in the street worker program, which identifies at-risk kids and helps keep them out of trouble. It’s impossible to separate salaries from the program, she said.

Thomas then questioned the purpose for bringing CHRC administrators into the hearing.
“This doesn’t pass the smell test,” Thomas said. “Let’s cut to the chase. We have the head of another African American organization begin dragged down here and grilled. There was a decision by a member of council to call a director and stop an action this council voted on. He went around the city manager, who happens to be African American.”

Berding said the reason for the hearing was to understand how CHRC was spending its money, and to make sure its efforts were aligned with other anti-violence programs. When asked if he was aware of Bortz’s phone call before it was made, Berding said: “I don’t know exactly how it transpired.”

Will Thomas, board president for the CHRC, said he is troubled that his organization is the only social service agency included in the 2007 budget that has been questioned about its spending.
“We don’t have anything to hide, but it did draw a red flag in my mind,” Thomas said. “Are they going to call in other agencies?”

Seems they could consolidate some administration expense by cutting this agency loose or another agency upside down with administration expense ?

Take 75,000 and give to the joint agency and save the city 39,000 ?

It would seem that it is the responsibility of the administrator though ?

Klepal needs to dig deeper. This whole event doesn't pass the smell test. Bortz unilaterally holding up Council's voted intent on the CHRC while Berding calls a hearing to review CHRC spending. Let us not forget that these two were part of the 5 that worked very hard to destroy the CHRC through huge reductions in the budget.

What is the Council's remedy for a council person who won't follow the City Charter? The claim of saving time is baloney. Can they censure him ?

And what of this differing story between Survey and Bortz. Someone is not telling the whole truth...and it was Bortz who was acting way too secretive on this event. Now the secret has gone public...and it appears Bortz is tap dancing and white washing.

OK Fiscal Five. Enough. I hope you realize how bad you have been coming off these past few months. Everyone thinks you're raising a ruckus and accomplishing nothing. Citizens largely see you as publicity-hungry jerks who take every opportunity to trash others not in your "cool kids" clique. If you don't knock it off soon, people are going to remember in time for the election. Stop cutting your own throats--it's hard to watch.

Doe$ the councilmember make the call$ to department$ to get action for their emolument$ or doe$ Uncle Dick'$ variou$ Wyatt Earp $taff handle that, too? $leight of hand and under the table, too? Bortz needs to know that when you take on a sacred cow, you need to follow the missal.
CHRC is a sacred cow, a home for the undead like the City Solicitor's office, the Citizens Committee on Youth, and the unlamented Planning Commission.
CHRC most assuredly needs close scrutiny, but since Bortz has stepped on toes, that will not happen.
Most unfortunate.

Jeff Berding has been running a group of five votes on all sorts of matters involving:

1-Secrecy
2-Breaking one's word
3-Threats
4-Payback
5-Charter violating
6-Racism
7-Grandstanding
8-Bullllshit
9-Cowardice

as they accomplish absolutely nothing.

Sure, the 5 fight over The Banks and The Jail and attack health clinics and social service programs. They have called a criminal investigation on Health Commissioner Nobel Maseru. They even held a hearing with no purpose other than to embarass and grill The Cincinnati Human Rights Commission. The 5 launched an unprecedented attack on Mark Mallory's city manager appointment. City Manager Milton Dohoney will go down in history with the votes cast against him. They have dismantled the arts funding and have attempted to end recycling and clean air initiatives.
A few of then fill big business ears with hot air to grab campaign cash for themselves, with no real profit to anyone else. They fight with vengeance and pettiness and grudges and fascism and convenience.

With these five starting crap no neighborhood is getting any favors.
They need to stop.

If you think this is a missed opportunity to gut more than the $60K and public humiliation that the people of CHRC went through, than you are an exact excuse for one of them.

They flipped the Chamber an extra $50K without winking an eye. Do you think Jeff Berding is going to grill Nick Vehr on his taxpayer financed travels in The Rules Committee?

This pact needs to end.

Don not put up with it.

The committee meeting was on cable- Berding was incredibly rude to Thomas and to Crowley. At one point he yelled at Thomas and said I'm the chair of this committee and you're not even a member and I LET you speak (paraphrasing, but I think the transcripts of committee meetings may be available somewhere)

Cervey is a lying SOB.....he promised an OUTSIDE EZ fiscal and operational audit of the EZ.....never happened.
Bortz has been spot on in all my dealings with him.
Bortz needs to replace Mayor Urkle!
