Are flyers harassment?

Some people circulating petitions to force a vote on a county sales tax increase say they are being “harassed” by sales tax proponents.

Sales tax proponents say that accusation is absurd.

The 0.5 percent sales tax would build a new jail and fund public safety programs.

Petition circulator Josh Weitzman said he and another circulator were "followed" as they attempted to gather signatures at a weekend festival. The followers handed out these flyers to everyone Weitzman asked to sign the petition.

"It reached the point that I was ready to go to the police and tell them to stop following me," he said. "They're trying to get their message out, but its harassment and intimidation to a certain extent."

But in fact, he didn't call police, and hasn't decided whether he will. After all, is it illegal to hand out flyers?

One of the so-called "harrassers" is sales tax proponent Pete Witte, a Republican who ran for Cincinnati City Council in 2003.

"Harassment? Ouch!" he said, when told of the allegations. All he and fellow volunteers are doing is handing out informational flyers and making sure potential petition signers have both sides of the issue, he said.

"We're encouraging possible petition signers to consider their options and the risk of delaying the kind of safety plan this county has needed for some time," he said. "The goal is to make sure people are fully informed when they're being asked to sign a petition." No harassment or intimidation involved.

Republican Commissioner Pat DeWine (who cast the sole vote against raising the sales tax) says its an attempt to thwart the referendum effort

"It's really sad that my colleagues on the Commission and their supporters have chosen to celebrate Independence Day by trying to prevent the citizens of Hamilton County from exercising their right to vote," he said. "Fortunately, the voters are smarter than that and despite the concerted efforts to block a public vote, I have every confidence the petitioners will succeed in collecting the necessary signatures to place the tax hike on the ballot."

Commissioner David Pepper (who with fellow Democrat Todd Portune, passed the sales tax in May) said the volunteers are doing nothing wrong.

Yes, "volunteers" have been handing out the flyers, he said. And yes, he and Portune have been working (though handouts, e-mail etc) to explain the safety plan to constituents, Pepper said. Yes, they have even used their personal money -- not county money -- to send letters to fellow Democrats.

But "the idea that our attempt to explain the issue is anything other than a first amendment debate is ludicrous," Pepper said.

He likened it to Republicans and Democrats handing out infomation on their candidate slates at the polls on Election Day. There's nothing shady about it.

So, the people touting democracy don't like having voters actually being informed on the issue before signing the petition.

Yeh, these fringe groups(far right and far left) only believe in the Constituion when it supports their propaganda - not when it supports informed consent. The growing masses are coming out against the extremist groups - they get it - we have to address the social problem of crime, recidivism and services!

The people touting democracy don't like being stalked. They have every right in the world to pass out their propagande, but it is intimidation when you are following a total stranger for 2 hours, all within an arms length. That is the kind of thing that gives people restraining orders.

If it's illegal to hand out fliers that give one side of the argument, then wouldn't it also be illegal to solicit signatures for the other side of the argument? On the contrary both are perfectly legal--and it would be a shame if petition circulators were standing out there spouting their garbled rhetoric without volunteers giving voters a chance to hear the other side.

Ask Donald and Marian Spencer, Odell Owens, Cecil Thomas and Judge Nathaniel Jones. They seem to be pretty supportive of a comprehensive plan that deals, finally, with recidivism and reform.

What are the anti-jail people afraid of? Citizens have a right to know what they're signing. There's nothing wrong with a little grassroots debate on BOTH sides.

Passing out flyers is at the heart of the First Amendment.

When one person is shadowing a stranger for hours at a time, keeping the victim within 5 feet of you at all times, that is harassment and the victims of this would be well within their rights to call the police. The only people supporting that type of behavior are stalkers or political extremists desperate to prevent citizens from having a voice in their own government.

What we need to get are some petition circulators who are also good runners. If you want to lose Pete Witte, just take a 1/2 mile jog and that slob would never be able to keep up.

If the antitax coalition can't make thier argument stand up against a sompeting argument, that's really telling, and sad. These fringe elements want to scream to the police-who they are publically against-when they need help. How ironic!

Now, that's pretty funny - the anti-Safety Plan group wants to call the police, maybe have someone thrown in jail - that IS funny -- that's hysterical!!!!
Tehy've really fallen for the Finney the Fink line, everyone in jail except us.Our rights, not yours

What does it say when the tax-hikers can't make their argument without impersonating me?

To the anonymous who posted one comment before my impersonator: I'm sure most black voters appreciate that the NAACP is standing up for their right to vote, particularly given the enthusiastic response of black voters who've been asked to sign the petition. I don't recall seeing where it's the NAACP's mandate to refuse to build bridges with diverse groups to accomplish their goals. Those of us who support taxpayers right will be happy to leave that narrow-minded thinking to our opponents.

Hypocricy!

Here it is, for all the world to see, cincyjeff in his own words;

"Smitherman doesn't understand the first thing about representing his organization in a professional manner. You notice that when he referred to black people, he capitalized the word, but when he referred to white people he kept it in lower-case. That may be fine if writing for Nate Livingston's blog, but it's inappropriate when representing a civil rights organization. Smitherman makes it real easy for everyone to recognize him as a racist.

As I see it the local NAACP needs to make two immediate changes:

1. Find a new President, one who isn't a racist.
2. Get some professional looking letterhead."

How quickly cincyjeff forgets his own comments slamming Smitherman on Cincinnati Blog. Too bad for him that Google never forgets!

I hope that all the 'greens' that are willingly climbing into bed with COAST, Finney, Brinkman, Cincyjeff et al now see that they are being used by this collection of right wing extremists. Wake up!

Butt Rooster, I don't have a problem with old comments being reposted. The issues I raised then were valid - Smitherman's language was racist and unprofessional.

I can also acknowledge that he's done a very good job working with a very diverse group of people, including whitey, to stand up for the right to vote of all residents. The coalition includes blacks, whites, conservatives, liberals, Republicans, Greens, Libertarians, and even some white Democrats. He's gotten off his butt and addressed the valid criticisms I raised.

That doesn't mean he automatically deserves our support. I think the voters should weigh the entire Chris Smitherman before deciding whether to vote for him. Just as we voters should decide The White Democratic Sales Tax Hike, we should also carefully evaluate candidates. Thank you for your thoughts.

I think it's pathetic that Pepper and Portune are clearly bankrolling this effort to steamroll their proposal through- does anyone know where the figures on how much of their "personal money" they've used might be found? Also the flier is tacky looking and poorly executed- maybe Pepper can get Daddy to print something more professional looking.They must be worried if they've gone to these lengths. If one of their people shadowed me I'd take their pictures and tape record their comments. Dean, Jeffre- go out and document this harassment.
