Judge allows elections probe to proceed
A judge has ruled against Rev. Donald Tye in his attempt to quash a Board of Elections investigation into his campaign activities.
Hamilton County Common Pleas Judge Mark R. Schweikert ruled Wednesday that the Board of Elections does have jurisdiction to probe whether Tye violated Ohio law by paying for a postcard attacking mayoral candidate David Pepper before the primary. The judge lifted his temporary restraining order blocking a hearing into the affair.
Tye's lawyer, Kenneth L. Lawson, did not immediately return a phone call seeking comment.
